Terms of Service

1. Acceptance of terms
By accessing or using the Offsider service you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service. The service is provided by OFFSIDER APP (ABN 35 621 314 403), referred to in these Terms as "Offsider", "we", "us", or "our".
2. Service description
Offsider provides a WhatsApp-based task and job management service for Australian tradespeople, together with a web dashboard for business owners and managers. The service uses artificial intelligence to assist with scheduling, quoting, and message drafting.
3. Eligibility
You must be at least 18 years old and operating a legitimate business in Australia to use the service. By using the service you represent that these conditions are true.
4. Your account
You are responsible for keeping your account credentials secure and for all activity on your account. You agree to provide accurate information and to keep it up to date. One account per business unless we agree otherwise in writing.
5. Acceptable use
You must not:
- Use the service for any unlawful purpose.
- Send spam, unsolicited messages, or harassing content.
- Attempt to reverse engineer, scrape, or interfere with the service.
- Upload malware or content that infringes others' rights.
- Use the service to make automated decisions with legal effect on others without appropriate human review.
6. Intellectual property
Offsider and its licensors own all rights in the platform, including software, designs, and documentation. You retain ownership of the content you submit (such as messages and media). You grant Offsider a worldwide, non-exclusive, royalty-free licence to host, process, and display that content solely to provide and improve the service.
7. Disclaimers
The service is provided "as is" and "as available". AI-generated outputs may be inaccurate, incomplete, or out of date. You must review AI outputs before relying on them, and the service is not a substitute for professional legal, financial, safety, or regulatory advice. To the extent permitted by Australian Consumer Law, we exclude all implied warranties.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of or relating to the service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim, or AUD 100 if no fees were paid. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the Australian Consumer Law.
9. Termination
You may stop using the service at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe doing so is necessary to protect the service or other users. On termination, the rights and obligations that by their nature should survive (including IP, disclaimers, limitation of liability, and governing law) will survive. Data retention on termination is governed by our Privacy Policy.
10. Governing law
These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have non-exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
11. Changes to these terms
We may update these Terms. We will notify active users of material changes via WhatsApp or email and update the "Last updated" date above. Continued use after notice constitutes acceptance of the updated Terms.
